SMS Policy

Purpose

The Er Law, PLLC (”we,” “us,” “Firm”) uses SMS/MMS for appointment reminders, case updates, and marketing communications only with your prior express consent.

Consent and TCPA compliance

By providing a mobile number you expressly consent to receive text messages from the Firm at that number. All marketing texts require prior express written or electronic consent in compliance with the Telephone Consumer Protection Act (TCPA) and related rules. We will not send automated marketing messages to a number without such consent.

Message content, frequency & cost

  • Typical messages: appointment reminders, limited case/status updates, billing notices, and promotional notices if you opted in.

  • Frequency: varies by case and communications preferences.

  • Carrier fees: standard carrier message and data rates may apply.

Confidentiality & limits

  • SMS is NOT a secure channel. Do not send privileged, sensitive, or confidential information (e.g., substantive case details, confidential documents, Social Security numbers) by text.

  • Texting does not itself create an attorney‑client relationship. To establish representation, follow the Firm’s intake procedures or confirm in writing.

Minors Do not provide mobile numbers for persons under 18.

Changes We may modify this policy. Material changes will be posted here with an updated effective date.
